To use our various facilities & services we have certain terms and conditions to be followed by the users. Please read the following terms and conditions carefully before registering on, accessing, browsing, downloading, or using the Anpay app.
In order to access certain Services, you may be required to provide information about yourself (such as identification, contact or payment details) as part of the registration process for the Service, or as part of your continued use of the Services. You agree that any registration information you give to us will always be true, accurate, correct, complete and up to date. Any phone number used to register with the Website needs to be registered in your name and you might be asked to provide supporting documents to prove the same.2.You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by Anpay, unless you have been specifically allowed to do so in a separate agreement with us;
The Terms and Conditions (as may be amended from time to time) is a legal contract and an agreement between you, an individual customer, member, user, or beneficiary of this service of at least 18 years of age ("You"), and Anpay (together with its subsidiaries and other affiliates, "us", "we", "Anpay"), regarding Your use of our prepaid mobile/DTH recharge services (known as "Service") to purchase prepaid mobile/DTH recharge (known as "Recharge") and related services on our website "www.anpay.in" (known as the "Site"). If you use any of the services provided by us through our app, you shall be exposed to the rules, guidelines, policies, terms, and conditions applicable to specific services, and they shall be deemed to be incorporated into these Terms & Conditions. We reserve the right to change, modify, add or remove portions of these Terms & Conditions, at any time without any prior intimation. It is your responsibility to review the Terms & Conditions periodically for updates or changes. Your continued use of the website authenticates that you accept and agree to the updation or changes done by us.
Anpay is not eligible to have contract with a minor, unsound or intoxicated person is void, as they are incompetent to contract. If you are a minor i.e. under the age of 18 years, you are only permitted to access our app under the supervision and prior consent of your parent or legal guardian. By accepting the TnCs or by accessing our Services on the Anpay , You represent that You are at least 18 years of age and have not been previously suspended or removed by Anpay, or disqualified for any other reason, from availing the Anpay Services. In addition, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all the TnCs as part of this Agreement. Finally, you shall not impersonate any person or entity, falsely state or misrepresent your identity, age, or affiliation with any person or entity. Finally, in the event of any violation of the TnCs, Anpay has the right to suspend or permanently prevent you from availing of service.
You will be issued a user ID and password to access Your account.You must keep the password confidential and not share it with any other person as You are responsible for all activity on Your account, whether or not You authorized it. We are a Reseller Only. Anpay does not provide mobile service and is only a reseller of prepaid mobile services by telecommunications service providers or the providers of such prepaid recharge (the ‘Telco’ or ‘Telcos’) or other distributors or aggregators of such Telco’s. Anpay is not a warrantor, insurer, or guarantor of the services to be provided by the Telco’s. Recharge sold by us to you is sold without recourse against us for any breach of contract by the Telco. Any disputes regarding the quality, minutes provided, cost, expiration, or other terms of the Recharge purchased must be handled directly between You (or the recipient of the Recharge) and the Telco.
Anpay provides you all the service in a single app so you will be responsible to maintain the confidentiality of your Display Name, Password, contact number, E-mail address, etc. your personal details is important to us to give you the best service, to contact you regarding the service to avail from us. We promise to secure your personal details provided to us. You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current, or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with these TnCs, We shall have the right to indefinitely suspend or block access of your membership on the website and refuse to provide You with access to the Website. It is your responsibility to ensure that your mobile phone number and your email address are up to date on the app at all times. You agree to notify us promptly if your mobile phone number or e-mail address changes by updating the same on the app through One Time Password verification. If You share or allow others to have access to Your account on the app (“Account”), by creating separate profiles under your Account, or otherwise, they will be able to view and access Your Account information. You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences there from.
As between you and Anpay, all Materials, trademarks, service marks, and trade names contained on the Site are the property of Anpay and/or third party licensors or suppliers. You shall not reproduce, distribute, transmit, modify, create derivative works, display, perform or otherwise use the Site, the platform or any of the IP rights, or attempt to reverse engineer, decompile, disassemble, or derive the source code for the platform or use the platform or Site to create a competing product. Anpay is owned byRECHARGEPOINT. unauthorized use is strictly prohibited. All rights are expressly reserved to Anpay.As between you and Anpay, all Materials, trademarks, service marks, and trade names contained on the Site are the property of Anpay and/or third party licensors or suppliers. When you use Services provided by Anpay send Text messages, Email, Voice call or any other communication mode will be electronically recorded by our end for quality purpose. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through the other Anpay, such as our Message Center, and you can retain copies of these communications for your records. If any misconduct or any violation of the TnCs, Anpay has the right to suspend or permanently prevent you from availing of service in the Anpay Application.
Notwithstanding anything to the contrary contained herein, neither Anpay, nor its affiliated companies, subsidiaries, officers, directors, employees or any related party shall have any liability to users or to any third party for any indirect, incidental, special or consequential damages or any loss of revenue or profits arising under or relating to these terms, the site or the offerings, even if any of said parties had been advised of, knew of, or should have known of the possibility of such damages. To the maximum extent permitted by law, our maximum aggregate liability to you for any causes whatsoever, and regardless of the form of action (whether liability arises due to negligence or other tort, breach of contract, violation of statute, misrepresentation or for any other reason), will at all times be limited to the transaction value.
You agree to indemnify, defend and hold Anpay and/or related parties harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including and without limitation legal fees and expenses, arising out of or related to your use or misuse of the Anpay, any violation of these Terms, or any breach of the representations, warranties, and covenants made by you You agree to defend, indemnify and hold Anpay, and its Team harmless from and against any claims, actions, demands, liabilities, judgments, and settlements, including without limitation, reasonable legal fees resulting from or alleged to result from your use of this Website. You hereby indemnify and hold Anpay, and its Team harmless from any loss, costs, damages, expenses, and liability caused by your use of the Website, your violation of this Agreement, or your violation of any rights of a third party through use of the Website.
Anpay may charge users certain fees for accessing our Website and Services as a whole, or certain features of the Website/Services. You agree to pay any such fees, as may be applicable to the Services that you use. All payments made against the purchases/services on application by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transactions with respect to any other form of currency with respect to the purchases made on. Anpay will try to ensure that you are made aware of the applicability of any fees for a particular use of the Website/Services, as well as the number of fees payable by you for any such use of the Website/Service. You agree that Anpay may, at any time, charge, modify or waive fees required to use the Website. Your continued use of the Website/Services after such change in the fees will be considered to be your acceptance of such changes, and the applicability of these Terms of Use to such changes.
Before shipping/delivering your order to you, the Seller may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to Our Users. And also you agree to provide correct and accurate financial information, such as credit/debit card details to the approved payment gateway or pre-paid payment instrument account details or net banking or UPI account details for availing Services on the app. You shall not use the credit/debit card or pre-paid payment instrument or net banking details or UPI ID which is not lawfully owned by you, i.e. in any transaction, you must use your own credit/debit card or pre-paid instrument account or net banking account or UPI ID. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation, or court order or in accordance with the terms of the Privacy Policy. You will be solely responsible for the security and confidentiality of your credit/debit card details or pre-paid instrument account or net banking details or UPI ID. Anpay expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of your credit/ debit card or pre-paid instrument account. You, as a Buyer, shall be entitled to claim a refund of the Transaction Price (as Your sole and exclusive remedy) in case You do not receive the Delivery within the time period agreed in the Transaction or within the time period as provided in the Policies, whichever is earlier. In case you do not raise a refund claim using Anpay features within the stipulated time then this would make you ineligible for a refund as well as understand that the Payment Facility may not be available in full or in part for certain categories of products and/or services and/or Transactions as mentioned in the Policies and hence You may not be entitled to a refund in respect of the Transactions for those products and /or services.
You may need your own Anpay account to use certain Anpay Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. You will be responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. Immediately notify Anpay of any unauthorized use of Your Account Information or any other breach of security, and ensure that you exit from Your Account at the end of each session. Anpay cannot and will not be liable for any loss or damage arising from your failure to comply with this section. You may be held liable for losses incurred by Anpay or any other user of or visitor to the Website due to the authorized or unauthorized use of Your Account as a result of your failure in keeping Your Account Information secure and confidential.
In addition to all Terms of this Agreement, you shall not:-
Your account may be disabled and Services may be terminated based upon the representations made by you. Any of the following actions may result in termination of Services:
You may not use contact information provided by us or other users or harvest such information for the purpose of sending, or to facilitate the sending, of unsolicited bulk communications such as spam. You may not allow others to use your account to violate the terms of this section. We may terminate your membership or access to the Website & App immediately and take other legal action if you or anyone using your credentials violates these provisions.
To the full extent permissible law, Anpay and its third-party partners disclaim all warranties or guarantees – whether statutory, express, or implied – including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. No advice or information, whether oral or written, obtained by you from Anpay or through Anpay Services will create any warranty or guarantee other than those expressly stated herein. For the purposes of this Disclaimer, You expressly acknowledge that as used in this section, the term “Anpay” includes Anpay officers, directors, and employees. You acknowledge that Anpay user. The Anpay services and all information, content, materials, products (including software), and other services included on or otherwise made available to you through the Anpay services are provided by Anpay on an "as is" and "as available" basis unless otherwise specified in writing. Anpay makes no representations or warranties of any kind, express or implied, as to the operation of the Anpay services, or the information, content, materials, products (including software), or other services included on or otherwise made available to you through the Anpay services unless otherwise specified in writing. You expressly agree that your use of the Anpay services is at your sole risk. It is your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, merchandise, and other information provided through the site or on the Internet.
If any provision of these Terms is, or is found to be, unenforceable under applicable laws, that will not affect the enforce ability of the other provisions of these Terms.
Anpay may elect to resolve any dispute, controversy, or claim arising out of or relating to this agreement or service provided in connection with this agreement by binding arbitration in accordance with the provisions of the Indian Arbitration & conciliation act, 1996. Any such dispute, controversy, or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in India, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. All administrative fees and expenses of an arbitration will be divided equally between you and us. In all arbitration, each party will bear the expense of its own lawyers and preparation. The language of the arbitration shall be English or Hindi.
All sales are final with no refund or exchange permitted. You are responsible for the information you provide for purchases and all charges that result from those purchases. Anpay is not responsible for any purchase of incorrect information provided. If in a transaction performed by you on the Site, money has been charged to your Anpay, credit/debit card, or bank account and recharge is not delivered within two hours of your completion of the transaction then you may inform us by sending an email to our customer services email address as mentioned. Anpay shall investigate the incident and if it is found that money was charged to your Anpay, credit/debit card, or bank account without delivery of the recharge then you will be refunded the money within 7 working days from the date of receipt of your email. All refunds will be credited to your original payment method.
Unauthorized transactions and Grievance Redressal
Anpay shares transaction alerts in the form of notification against debit to Your Anpay wallet In case You observe any transaction on Your account which is not processed with Your consent/ authorization, You should immediately report such transaction to Us via the emergency dispute@anpay.in or support@anpay.in as made available to You by Anpay.
There is no expiry date for your Anpay Wallet.
